SECTION 1 - WHEN DO WE COLLECT YOUR INFORMATION?

When you purchase something from our store (the “Site”), as part of the buying and selling process, and correspond with us through the Site, we collect the personal information you provide us such as your name, address, email address, and phone number.

SECTION 2 - AUTOMATIC DATA COLLECTION

We also use automatic data collection technologies to collect information about your equipment, browsing actions and patterns as you navigate through the Site.  The technologies we use for this automatic data collection include, but are not limited to, cookies and IP address logging. 

Cookies are small amounts of data downloaded to your computer to track movements and behavior within websites. We may use cookies to deliver content specific to your interests and for other purposes. We may collect information on the frequency that certain digital activities are accessed, how much time is spent engaging certain informational content and which links are clicked. We may link cookie information to personal information. Cookies we may use include, but are not limited to:

_session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by the Site provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to the Site by a single customer.
cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional storefront_digest, unique token, indefinite If the Site has a password, this is used to determine if the current visitor has access.

Most browsers are automatically set to accept cookies whenever you visit a website. You can disable cookies or set your browser to alert you when cookies are being sent; however, some areas of the Site will not function properly if you do so. We also maintain log files which contain internet protocol (IP) addresses. When you browse the Site, we automatically receive your computer’s IP address in order to provide us with information that helps us learn about your browser and operating system.

We use the information that we collect about you or that you provide to us, including any personal information, (i) to present the Site and its contents to you; (ii) to provide you with information, products or services that you request from us; (iii) to provide you with notices about your account; (iv) to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; (v) to notify you about new developments, features and enhancements to the Site and our products; (vi) to solicit feedback from you; (vii) to fulfill any other purpose for which you provide it; and (viii) for any other purpose with your consent.  

We may disclose aggregated information about the Site’s users, and information that does not identify any individual, without restriction.  We may disclose information that we collect or you provide as described in this Privacy Policy (i) to any subsidiaries and affiliates; (ii) for internal marketing and demographic studies; (iii) to Shopify and other third-party service providers we use to support our business; (iv) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which information held by us about the Site is among the assets transferred; (v) to fulfill the purpose for which you provide it; and (vi) to any other parties with your consent.

We may also disclose your information (i) to enforce legal rights and comply with any court order, law or legal process, including to respond to any government or regulatory request; (ii) to enforce or apply our own Terms of Service and other agreements, including for billing and collection purposes; and (iii) if we believe disclosure is necessary or appropriate to protect the rights, property or safety of us, our customers or others.  This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

How do you get my consent?
By browsing the Site, providing us with personal information to complete a transaction, placing an order, arranging for a delivery or returning a purchase, you signify consent to this Privacy Policy.  If you do not agree to this Privacy Policy, your choice is not to use the Site.

SECTION 5 - SHOPIFY

The Site is hosted on Shopify Inc (“
Shopify”). They provide us with the online e-commerce platform that allows us to sell our products and services to you.  Your data, including your credit card, is stored through Shopify’s data storage, databases and the general Shopify application. Because we cannot control Shopify, we are not responsible for the storage, use, or disclosure of your data by Shopify, and we cannot guarantee Shopify will adhere to this Privacy Policy.  You should consult Shopify’s Terms of Service (https://www.shopify.com/legal/terms) or Privacy Statement (https://www.shopify.com/legal/privacy) before providing any personal or other information.

SECTION 6 - THIRD-PARTY SERVICES

From time to time, we may engage other third-party service providers in order to sell our products and services to you. Because we cannot control third-party service providers, we are not responsible for the storage, use, or disclosure of your information by them, and we cannot guarantee third-party service providers will adhere to this Privacy Policy.  You should consult a third-party service provider’s terms of service or privacy policy before providing any personal or other information.

When you click on links on the Site, they may direct you away from the Site. Once you leave the Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or the Site’s Terms of Service. We are not responsible for the privacy practices of third-party service providers and encourage you to read their terms of service and privacy policies.

SECTION 7 - SECURITY

We will only collect and use information in accordance with this Privacy Policy to the extent deemed reasonably necessary to serve our legitimate business purposes, and we will use commercially reasonable physical, managerial and technical safeguards to preserve the security, integrity, accuracy and privacy of the information you have provided. We will take commercially reasonable steps to ensure that any third-party service providers to whom we transfer any information also use commercially reasonable safeguards.

The safety and security of your information also depends on you. You are responsible for keeping your account and password confidential. We ask you not to share your account or password with anyone. 

Unfortunately, we cannot ensure or warrant the security of any information you transmit to us.  Any transmission of information is at your own risk. We use commercially reasonable efforts to ensure the security of such information on our systems; however, we cannot guarantee that such information will not be accessed, disclosed, altered or destroyed by breach of any of our physical, managerial, technical or other safeguards.

If we learn of a security systems breach, then we will use our commercially reasonable efforts to notify you electronically so that you can take appropriate protective steps. We may post a notice on the Site if a security breach occurs.

SECTION 8 - AGE OF CONSENT

The Site is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Site. We do not knowingly collect information from children under 13. If you are under 13, do not use or provide any information on the Site or on or through any of its features, register on the Site, make any purchases through the Site, use any of the features of the Site or provide any information about yourself to us, including your name, address, telephone number, email address, or any user name you may use. If we learn we have collected or received information from a child under 13, we will delete that information. If you believe we might have any information from or about a child under 13, please email preorders@theaviarybook.com.  If you are between 13 and 18 years of age, you may only use the Site with the involvement of your parent or legal guardian.

SECTION 9 - CALIFORNIA RESIDENTS

Under California law, California residents who have an established business relationship with us may choose to opt out of our disclosure of personal information about them to third parties for direct marketing purposes. Our policy is not to disclose personal information collected online to a third party for direct marketing purposes. SECTION 10 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. We indicate at the top of the page when this Privacy Policy was last modified or updated. Your continued use of the Site following any modification constitutes and signifies your full acceptance of the changes. Changes and clarifications will take effect immediately upon their posting on the Site. If we make material changes to this Privacy Policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If the Site is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

We may not accommodate a request to change personal information if we believe the change would violate any law or legal requirement or cause the personal information to be incorrect.  If you delete any personal information, we may retain your personal information in our electronic data and other files and use your personal information as necessary to maintain the security, integrity and operation of the Site, to comply with our technical and legal obligations, to resolve disputes and enforce our agreements and policies, and to take other actions required or permitted by law. In addition, if certain information has already been provided to third-party service providers as described in this Privacy Policy, retention of that information will be subject to those third-party service providers’ terms of service and privacy policies.
